Welcome to Airsoko Limited (hereinafter referred to as “Airsoko”). Airsoko offers various website features, products, and services when you visit or shop on the Airsoko website, utilize Airsoko products or services, access Airsoko mobile applications, or use software provided by Airsoko in connection with these offerings (collectively, "Airsoko Services").
1. Acceptance of Terms
1.1 By accessing the Airsoko website or applications, you acknowledge that you have read, understood, and agreed to the Terms and Conditions and Privacy Policies (collectively, “this Agreement”). If you do not agree to this Agreement, you must refrain from using Airsoko Services. By completing the registration process and selecting the "I agree with the Terms and Conditions & Privacy Policies" option, you confirm your acceptance of and agreement to be bound by this Agreement.
1.2 Airsoko Services provide a platform for transactions between sellers and users. The actual sales contract is directly between the seller and the user; Airsoko is not a party to this or any other contract between the seller and the user, and Airsoko accepts no responsibility or liability in connection with such contracts. Sellers and users are solely responsible for their transactions, including product listings, warranties, and related obligations.
1.3 Airsoko reserves the right to modify, upgrade, limit, or suspend services or features without prior notice. New features, applications, or services may also be introduced at Airsoko's discretion.
1.4 This Agreement applies exclusively to users in Kenya.
2. Registration
2.1 To access certain Airsoko Services, you may need an Airsoko account, which requires you to be logged in with a valid payment method. Should issues arise with your selected payment method, alternative payment options may be provided. You are responsible for maintaining the confidentiality of your account and password and for any activities that occur under your account.
2.2 By completing the registration process or using Airsoko Services, you confirm that you are of legal age, possess full legal capacity, and are responsible for any actions taken under your account. If you lack legal capacity and cause harm, responsibility will be borne by you and your guardian.
2.3 Users must provide truthful, accurate, complete, and up-to-date information during registration. Failure to do so may result in termination of this Agreement, and users will be held accountable for any resulting consequences.
2.4 Your information must not infringe upon the rights of others. If infringement occurs, Airsoko reserves the right to cancel your account and pursue legal recourse.
2.5 You are responsible for safeguarding your username and password. Unless otherwise provided by law or judicial ruling, or with Airsoko’s approval, your username and password may not be transferred, gifted, or inherited (except property rights related to the account).
2.6 Users must not share their account information or store it on other devices. Any resulting consequences will be the sole responsibility of the user, who may also be held jointly liable with the actual user of the account.
2.7 If you are underage according to Kenyan law, you may only use Airsoko Services with the consent of a parent or guardian. Certain listings, such as alcohol and adult products, are intended for adults, and you must meet all legal age and regulatory requirements to make such purchases. Airsoko reserves the right to refuse service, terminate accounts, revoke access to Airsoko Services, remove content, or cancel orders at its sole discretion.
3. Privacy and Authorization
3.1 At Airsoko, we prioritize your privacy. We will maintain strict confidentiality regarding your information and activities on our website and applications, including browsing, shopping, placing orders, and sharing details. This includes your real name, contact information, address, phone number, email, and other personal data. Airsoko will not disclose this information to third parties except as authorized by you, as stipulated in this Agreement, or as required by law.
3.2 Airsoko may contact you through autodialed or prerecorded calls, text messages, or emails for the following purposes:
(i) Account notifications;
(ii) Troubleshooting account issues;
(iii) Dispute resolution;
(iv) Surveying opinions through questionnaires;
(v) Necessary service communications or enforcement of this Agreement, our policies, applicable laws, or other agreements. Airsoko may also use these methods for marketing purposes (e.g., offers and promotions) with your consent.
3.3 We may share your phone number and email with authorized service providers, who may contact you via autodialed or prerecorded calls, text messages, or emails solely for the purposes outlined above and as authorized by Airsoko.
3.4 If you discover any unauthorized use that jeopardizes the security of your account or misuse of your personal information, you must promptly notify Airsoko to suspend the relevant services and report to public security authorities. Please understand that Airsoko requires a reasonable period to address such issues and will not be liable for any losses unless the unauthorized use is due to Airsoko's fault and we fail to address the issue after receiving written notice.
4. Copyright
All content available through Airsoko Services, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Airsoko or its content suppliers and is protected by international copyright laws. The compilation of all content is the exclusive property of Airsoko and is also protected by international copyright laws.
5. Property Rights
5.1 Airsoko exclusively owns or is the licensed provider of all rights related to Airsoko Services, which include commercial secrets and intellectual property protected by relevant laws. All rights, title, and ownership of Airsoko Services are reserved by Airsoko and/or its affiliates.
5.2 The trademarks "Air," "Soko," "Airsoko," and related logos, icons, trade names, domain names, and other marks (whether registered or not) (collectively, “Marks”) belong to Airsoko and/or its affiliates and are protected by copyright, trademark, and other intellectual property laws. Unauthorized reproduction, modification, use, or publication of these Marks is prohibited.
6. Trademarks
Additionally, graphics, logos, page headers, button icons, scripts, and service names used in or available through Airsoko Services are trademarks or trade dress of Airsoko in Kenya and other countries. These trademarks and trade dress must not be used in connection with any product or service not affiliated with Airsoko in a manner that could confuse customers or disparage Airsoko. All other trademarks not owned by Airsoko that appear in Airsoko Services are the property of their respective owners and may be affiliated with Airsoko.
7. License and Access
Subject to your compliance with this Agreement and applicable laws, and your payment of any applicable fees, Airsoko or its content providers grant you a limited, non-exclusive, non-transferable, non-sub-licensable license to access and use Airsoko Services for personal, non-commercial purposes. This license does not include any resale or commercial use of Airsoko Services or its contents; collection or use of any product listings, descriptions, or prices; derivative use of Airsoko Services or its contents; or any use of data mining, robots, or similar tools. All rights not expressly granted to you are reserved by Airsoko or its licensors. You may not reproduce, duplicate, copy, sell, resell, visit, or exploit Airsoko Services or any part of it for commercial purposes without express written consent. Framing or use of Airsoko’s trademarks or proprietary information without express written consent is prohibited. Misuse of Airsoko Services is not permitted. Licenses granted by Airsoko terminate upon non-compliance with this Agreement or applicable laws.
8. Reviews, Comments, Communications, and Other Content
8.1 You may post reviews, comments, photos, videos, and other content; send e-cards and communications; and submit suggestions, ideas, or questions, provided that the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise objectionable. Content must not contain viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or spam. Misleading content, including false email addresses or impersonation, is prohibited. Airsoko reserves the right to remove or edit such content but is not obligated to review posted content regularly.
8.2 By posting content, you grant Airsoko a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, perform, translate, create derivative works from, distribute, and display the content worldwide in any media. You also grant Airsoko the right to use your name in connection with the content if desired. You affirm that you own or control all rights to the content and that its use does not violate this policy or harm any person or entity. You agree to indemnify Airsoko for claims arising from your content. Airsoko may monitor, edit, or remove content at its discretion and is not responsible for content posted by you or third parties.
8.3 If you post product comments or share content, you agree to make the comments public and accept responsibility for them, even if they appear on external platforms. By posting non-anonymously, you consent to disclosing non-sensitive contact information and other personal details.
9. Returns and Refunds
9.1 Users may request returns and refunds under certain conditions for items that:
(i) Do not match the product description;
(ii) Are incorrect;
(iii) Are counterfeit;
(iv) Are missing parts;
(v) Are defective.
Refunds may be issued at our discretion without requiring a return. In such cases, returning the item is not necessary.
9.2 Returns are not accepted for the following items:
(i) Products not purchased from Airsoko;
(ii) Expired products;
(iii) Items with unauthorized repairs, misuse, or alterations;
(iv) Warranty cards that do not match the product or have been altered;
(v) Underwear, adult products, or similar items;
(vi) Global orders for non-defective products;
(vii) Items missing accessories or free gifts.

10. Product Descriptions
10.1 Airsoko strives to provide accurate information. However, Airsoko does not guarantee that product descriptions or other content on Airsoko Services are accurate, complete, reliable, current, or error-free.
10.2 Users acknowledge that it is the seller’s responsibility to describe products accurately. If a product does not match its description, your only recourse is to request a return of unused items.
11. Pricing
11.1 "List Price" refers to the suggested retail price provided by sellers. While we regularly compare List Prices against recent prices on Airsoko and other sellers, Airsoko does not guarantee the accuracy or legitimacy of these List Prices.
11.2 For items listed on Airsoko’s website or applications, the price cannot be confirmed until you place an order. Despite our efforts, some items may be mispriced. If the listed price is significantly higher than the market price, we may choose to remove the item at our discretion. Price discrepancies may arise from different merchants or sellers.
12. Payment
12.1 Airsoko does not directly handle payments; these services are provided by third parties such as Safaricom (M-Pesa) and Airsoko Pay (card payments/other mobile money). For more information, refer to the "Payments Information and Guidelines". Users must follow these guidelines when using Airsoko Services.
12.2 Users can request invoices, receipts, or vouchers from the sellers or third-party payment agencies if fees are charged. Airsoko does not charge fees or issue invoices or receipts.
12.3 Users must ensure their payment information is accurate and are responsible for maintaining the confidentiality of their payment account and password.
12.4 Airsoko has not authorized any third parties to handle purchases or payments on its behalf. Users should only make purchases and payments through official channels. Airsoko is not liable for any losses incurred through unofficial channels.

13. Disclaimer of Warranties and Limitation of Liability
13.1 Airsoko Services and all associated information, content, materials, products (including software), and services are provided on an "as is" and "as available" basis unless otherwise stated. Airsoko makes no warranties of any kind, express or implied, regarding the operation of Airsoko Services or the information and materials provided.
13.2 To the fullest extent permitted by law, Airsoko disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose. Airsoko does not guarantee that the Airsoko Services, information, content, materials, products (including software), or electronic communications are free of viruses or other harmful components. Airsoko is not liable for any damages arising from the use of Airsoko Services, including direct, indirect, incidental, punitive, or consequential damages, unless otherwise specified in writing.
14. Disputes
14.1 In the event of a transaction issue, users and sellers should first attempt to resolve the dispute through mutual discussion, which Airsoko may facilitate. If the dispute cannot be resolved, Airsoko may intervene in disputes related to transactions carried out through Airsoko after-sale applications.
14.2 Users agree not to bring any claims against Airsoko or its affiliates (except where Airsoko or its affiliates are the sellers involved) regarding transactions on the Airsoko website or applications.
14.3 Any disputes related to your use of Airsoko Services or products purchased through Airsoko will be resolved through binding arbitration, not in court. Arbitration proceedings will be conducted individually, not as a class action.
15. Transactions Between Users and Sellers
15.1 When shopping on Airsoko, users should carefully verify product details, including name, price, quantity, type, specification, and size. Ensure accuracy in order details, payment, consignee information, and shipping address. Users are responsible for any inaccuracies and Airsoko reserves the right to terminate services if registration information is incorrect.
15.2 Order information is auto-generated based on user input. The sales contract is between the user and the seller, and the shipment contract is between the user and the carrier. Airsoko may provide seller information if necessary.
15.3 Users may cancel orders only with the seller’s approval before dispatch. If an item is out of stock, a refund will be issued without additional compensation.
15.4 Risk of delivery transfers to the seller or carrier once the order is effective. Airsoko provides estimated delivery times, but actual delivery may vary. If an order is lost or damaged, a refund will be issued. Unclaimed orders are held for 30 days; after that, Airsoko may dispose of them. Force majeure or other reasons may delay delivery.

16. Limitation of Liability
16.1 Airsoko is not liable for damages resulting from any situation, including but not limited to loss of profits, goodwill, data, or intangible losses; unauthorized third-party account use; misunderstanding of Airsoko Services; or any other loss not due to Airsoko's fault.
16.2 Airsoko is not liable for damages due to force majeure, routine equipment maintenance, network failures, system failures, power outages, labor disputes, data insufficiencies, or actions by third parties that affect Airsoko Services. Airsoko will assist in addressing related issues.
16.3 Airsoko is not responsible for losses or damages arising from incorrect shipping or payment information provided by users or errors in remittance.
16.4 If Airsoko is found liable, our liability is limited to the value of the goods purchased, excluding freight, customs, duties, and other charges.
17. Your Representations and Warranties
17.1 You represent and warrant that:
(i) You have the legal capacity (and if a minor, valid consent from a parent or guardian) to enter into this Agreement and comply with its terms; and
(ii) You will use Airsoko Services lawfully and in accordance with this Agreement and all applicable laws, rules, and regulations.
17.2 If you violate this Agreement or the law, including using hacking techniques or fraud, Airsoko may cancel your account, freeze account funds, and pursue liability, including reporting to authorities and seeking compensation for losses.
18. Applicable Law
18.1 By using Airsoko Services, you agree that all agreements and legal documents are governed by Kenyan law, without regard to conflict of laws principles.
19. General
19.1 This Agreement includes all policies and rules published and amended on Airsoko's website or applications, such as the After-Sales Return Policy and the Payments Information and Guidelines.
19.2 If any provision of this Agreement is deemed unlawful, void, or unenforceable under the law of any jurisdiction, that provision will be considered severable from these terms and conditions. This will not affect the validity or enforceability of any remaining provisions in that jurisdiction, nor the validity and enforceability of the provision in question under the law of any other jurisdiction.
19.3 Airsoko may modify this Agreement at any time by posting the revised terms on its website or through other means of notification. Continued use of Airsoko Services after such changes indicates acceptance of the revised Agreement.
